1. Who we are

The App is provided by XiangDa ("we", "us", "our"), an individual developer acting as a trader. By installing, accessing, or using the GitCode Viewer mobile application and any updates to it (the "App"), you agree to these Terms. If you do not agree, please do not install or use the App.

You can contact us at ada87@163.com. Our business address and telephone number, as required for traders by European Economic Area (EEA) and UK consumer law, are published on our Google Play developer page. How we handle data is described in our Privacy Policy.

2. The App and your licence

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited licence to install and use the App on devices you own or control, for your own use. You may not copy, sell, rent, sublicense, or redistribute the App except as permitted by the app store or by mandatory law; reverse engineer, decompile, or disassemble it except to the extent permitted by mandatory law; remove or alter proprietary notices; or use the App in violation of the law or of third-party rights.

We do not require an account and do not operate a backend that stores your data. Git credentials, SSH keys, access tokens, AI API keys, settings, cloned repositories, and notes you create are stored only on your device. You are responsible for keeping your device and credentials secure, for having the right to access any repository you clone or open, and for complying with the terms of your Git hosting provider and AI provider. If you uninstall the App or lose your device, data stored by the App may not be recoverable.

3. Free features, the one-time upgrade, refunds and consumer rights

The App can be used free of charge with limitations (for example, a limit on the number of repositories you can add). A one-time in-app purchase ("Unlock All Features") removes those limitations and unlocks the premium features described in the store listing. It is not a subscription. Prices, currency, and applicable taxes are shown by the app store before you confirm a purchase.

Purchases are processed by Google Play or the App Store, are tied to the store account used for the purchase, and do not transfer between platforms: an Android purchase does not unlock the iOS app, and vice versa. Where the store supports it, you can restore your purchase on the same platform.

Refund requests are handled under the store's refund policy. You can also contact us and we will help where we can. If you are a consumer in the EEA or the UK, you may have a statutory right to withdraw from a purchase of digital content within 14 days. Where the law allows, that right ends once the digital content is supplied with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal; the App is made available immediately after payment. Nothing in these Terms limits mandatory consumer rights available to you in your country of residence.

We may add, change, or remove features in future versions. Material changes to paid features will be described in the release notes.

4. Third-party services and the AI assistant

The App connects directly from your device to third-party services that you choose, such as Git hosting providers (GitHub, GitLab, Bitbucket, Azure DevOps, Gitea, Gitee, CNB, and self-hosted servers), AI model providers, and the app stores. We do not control those services and are not responsible for their availability, content, or terms; your use of them is governed by their own agreements and privacy policies. If you use the iOS version, Apple's Licensed Application End User License Agreement also applies.

The AI assistant works with your own API key: you choose the provider, and requests are sent from your device directly to that provider. AI usage may incur charges billed by your AI provider, and we do not receive any part of those charges. AI output can be incomplete, inaccurate, or unsuitable for your purpose, and it is not professional advice. Review it before relying on it, and do not send content to an AI provider that you are not allowed to share.

5. Acceptable use

You agree not to use the App for unlawful purposes or to infringe the rights of others; to access repositories or data you are not authorised to access; to bypass, disable, or circumvent the paid upgrade or other technical protection measures; to distribute malware or to attack, overload, or probe systems; or in any way that violates the terms of a Git host, AI provider, or app store.

6. Disclaimer and limitation of liability

To the maximum extent permitted by law, the App is provided "as is" and without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that AI output, document rendering, or Git operations will be accurate or uninterrupted, or that the App will always be available or compatible with every device or file format.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of, or inability to use, the App. Our total liability for claims relating to the App is limited to the amount you paid for the App in the twelve months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud, and nothing limits your mandatory consumer rights or guarantees.

7. Termination

You may stop using the App at any time and uninstall it. We may suspend or end your licence if you materially breach these Terms. Sections that by their nature should survive termination, including disclaimers and limitation of liability, survive termination.

8. Changes to these Terms

We may update these Terms from time to time. The new version will be posted on this page with a new effective date, and material changes will be communicated where required, for example in the store listing or release notes. Continuing to use the App after the effective date means you accept the updated Terms.

9. Governing law, disputes and contact

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of the mandatory protections of the law of your country of residence, and you may bring proceedings before the courts competent under that law. Before starting formal proceedings, please contact us at ada87@163.com so that we can try to resolve the matter.
